What can I expect with a Drug charge?

While marijuana is legal in the bordering states of Illinois and Michigan, it is illegal in Indiana. Any amount less than 30 grams is a misdemeanor offense, while possessing at least 30 grams of marijuana is a felony.


In the event you are charged with cultivating or selling cannabis the penalties can be even more severe.


Indiana divides what it considers to be controlled substances into 5 "schedules" based on factors such as their medicinal uses and potential for abuse. Schedule I drugs have the highest potential for abuse and no accepted medical use, and Schedule V drugs have accepted medical uses and the lowest potential for abuse. Drug schedules change frequently. You can find the definition for each drug schedule category on Indiana's Department of Health website.
